Student Rights & Responsibilities - Initiation of Disciplinary

STUDENT RIGHTS AND RESPONSIBILITIES:  INITATION OF DISCIPLINE

Any member of the college community may file a request for disciplinary action of a student for violation(s) of the rules of student conduct. Such a request must be submitted in writing to the Vice-President for Student Services within ten (10) calendar days of the occurrence giving rise to the request or the date the requestor could know or could reasonably have known of the occurrence. The written request must be signed by the individual making the request. The Vice-President for Student Services may decline the request, implant the request, or engage in information negotiations to resolve the situation.                                             
Disciplinary proceedings will be initiated by the Vice-President for Student Services, who may also establish advisory panels to advise or act for the office in disciplinary proceedings.
         
If in the opinion of the Vice-President for Student Services the accused student's presence on campus represents a threat of danger or disruption, the student may be placed on suspension pending the commencement of disciplinary action.

After considering all evidence in the case and interviewing the accused, the College may take any of the following actions:

1.               1.  Terminate the proceeding, exonerating the accused.

2.                  2.  Dismiss the case after whatever counseling and advice may be appropriate.

3.            3.  Impose sanctions directly, such as loss of privileges,, restitution, discretionary sanctions, revocation of admission   
             and/or degree, withholding a degree, formal warning, disciplinary probation, suspension, deferred suspension or
             expulsion.

4.           4.  Referral of the matter to the Student Affairs Committee.

A student found to have violated any provision of the code of student conduct shall be provided written notification of the action designated by the Vice-President for Student Services or his/her designee. Such written notice shall be either be delivered personally or mailed by first-class mail to the student’s last known address. The notice should advise the student of his/her right to appeal under these rules.

Disciplinary action recommended by the Vice-President for Student Services is final unless the accused student exercises his/her right of appeal as provided in Administrative Procedure #431.03.
